On www.monegrosfestival.com, you will have an online shopping service available 24 hours a day, where you can comfortably purchase tickets and / or combined packages for Monegros Desert Festival 2020.

We want to make your purchase through our website as much easy, agile and fair as is feasible, so that you can get to go to Monegros Desert Festival as quickly and easily as possible. In order to do so, we may use third-party platforms or Authorized Sales Channels, so you must read these Terms and Conditions in accordance to the ones of the authorized ticket agent from which you purchased your ticket.

It is very important that you carefully read these Terms and Conditions prior to purchase, as well as the terms and conditions of application to the Authorized Sales Channel. That is because purchase of any product on our website, or Authorized Sales Channel, constitutes your full acceptance of them. For this reason, if you do not agree with each and every one of these Terms and Conditions (or the terms and conditions applicable to the Authorized Sales Channel), you must not place any order. Also, keep in mind that Terms and Conditions are subject to change from time to time, so you should read them before placing every order.

You should consider that using this website implies your condition of user and your acceptance of our Terms of Use (link). In the same way, the acquisition of any product through our website implies acceptance of every provision included in these Terms and Conditions.

ACCEPTANCE AND INCORPORATION OF TERMS AND CONDITIONS INTO THE CONTRACT

These Terms and Conditions (hereinafter, T&C) stablish the conditions, rights and obligations that are applicable to the acquisition you make of tickets and / or combined packages on the website www.monegrosfestival.com (hereinafter, the Website) or any other Authorized Sales Channel, regarding Monegros Desert Festival 2020 (hereinafter, the Festival). The Festival will take place on 1st of August 2020, (opening and closing times are yet to be announced) at Km. 416, Nacional 2, 22520 Fraga (Huesca).

We let you know that the Promoter of the Festival is MONEGROS MUSICAL, S.L., sole-shareholder company, with registered office at Carretera N-II km 437, (22520) Fraga - Huesca, Spain, provided with N.I.F. B-22.429.971, and duly registered in the Mercantile Registry of Fraga (hereinafter, the Promoter).

As a user of the Website and attendant to the Festival, you DECLARE:

  1. that according to current Spanish Law you are a person of legal age;

  2. that you have the necessary legal capacity to act and to conclude a contract on the Website in accordance with these T&C, which you declare to understand and accept;

  3. that you have full capacity to use credit cards and that they have sufficient funds to cover all costs resulting from the purchase of products of the Website and / or Authorized Sales Channel;

  4. that by clicking on “Buy Tickets” during the purchase process, you ACCEPT fully and with no reservations all of these T&C and our Privacy Policy.

TICKETS AND WRISTBANDS

Tickets purchased on the Website, or through any Authorized Sales Channel, allow you (as an Attendant) to access to the Festival’s venues from the opening time on 1st of August 2020 until the closing time on 2nd of August 2020 (opening and closing times are yet to be announced by the Promoter)

It is not allowed the purchase of tickets or access to the Festival to anyone under EIGHTEEN YEARS OLD.

Tickets can only be purchased on the Website and through an Authorized Sales Channel (link al listado de canales de venta, de momento entiendo que solo es la Web, pero hablado con David, que se abra una ventanilla donde vayáis colgando los distintos canales de venta que vayáis utilizando). The Promoter will not be responsible for any tickets that haven’t been purchased through these channels. Both the sale platform of the Website and Authorized Sales Channels are operated by third parties; therefore, sale procedure will be stablished by the applicable terms and conditions (specifically, but with no limitation, regarding payment methods, gateways and information security).

Ticket price is subject to change. The price charged to the consumer will be the applicable at the time at which the purchase has been made.

When making a purchase on the Website, or any other Authorized Sales Channel, the user declares to have read and understood every information related to ticket purchase and the conditions of the Festival. This information can be found on the Website and includes a general description of the Festival and other relevant information, as well as some recommendations in relation to the Festival considered appropriate by the Promoter.

Tickets will be exchanged for a wristband that security staff will put on the Attendant. The Promoter will carry out electronic security controls, in which any fraudulent or fake tickets will be detected.

Any tickets can be invalidated if appear to be modified, broken, with signs of counterfeiting or with any other anomaly or defects. The wristband is what gives you access to the Festival’s venues. The Promoter will not be responsible for any Ticket that is lost, stolen or destroyed. The Attendant will be the only responsible for the safe-keeping of their ticket. The loss or destruction of the wristband means the non-admission or ejection of the Festival. The Attendant will also be responsible of checking that the wristband has been put on correctly, since under no circumstances will the Promoter provide any Attendants with another wristband.

Any person seeking to make a scam or trespassing and / or damaging the private property will be liable to legal action pursued by the Promoter.

THE POSSESSION OF A TICKET DOES NOT ENTITLE ITS OWNER OR THIRD PARTIES TO USE IT, OR ITS CONTENT, FOR ADVERTISING, MARKETING OR PROMOTIONAL PURPOSES (INCLUDING CONTESTS, GIFTS AND / OR DRAWINGS). BREACH OF THIS POINT IMPLIES A PENALTY FOR THE ADVERTISER AND / OR NOT AUTHORIZED USER EQUIVALENT TO ONE THOUSAND PERCENT OF THE PRICE OF ACQUISITION OF THE TICKET, WITHOUT LIMITATION TO THE RIGHT OF THE PROMOTER TO CLAIM DAMAGES.

REFUNDS AND CANCELLATION

Tickets cannot be exchanged or refunded unless the Festival is cancelled.

The Promoter will have power to change or cancel any of the acts and performances scheduled for the Festival.

In case the Festival is totally cancelled, the Promoter will refund users with the amount payed for the ticket, as set by these T&C. The cost of distribution will not be refunded, since the provision of service is understood to be made at the time of purchase of the ticket.

No refunds or compensation will be considered when the cancellation of the Festival is due to force majeure or when the cancellation occurs once the Festival has already started. Neither will be considered any refunds for reasons such as bad weather conditions or schedule changes. Under no circumstances will Monegros Musical be responsible for breach of contract in cases of force majeure (including weather events).

All this to the fullest extent permissible in Law.

ENTRY AND ACCESS TO THE FESTIVAL

Festival Venues are located at Km. 416, Nacional 2, 22520 Fraga (Huesca).

The Promoter reserves the right to refuse you to entry to and/or eject you from the Festival. Users will be refused admission to or removed from the Festival for any of the following reasons:

  1. If the user does not comply with the norms stablished by the Promoter
  2. If the user has a violent behaviour, puts on risk the safety of the Festival or hinders the normal development of the Festival.
  3. If the user introduces, carries or uses any kind of weapons or objects that could produce the same results such as sharp weapons, or that are considered dangerous for safety.
  4. If the user performs disturbances or annoying, unhealthy, harmful, dangerous or illegal activities.
  5. If the user is in possession or deals with drugs or other narcotics. Or if the user is acting under severe influence of alcohol or narcotics.
  6. If the user does not comply with age restrictions.

If the you are refused admission to or ejected from the Festival, you will not be entitled to any refunds and your wristband will be removed.

Admission to the Festival is subject to have the ticket in good conditions. The ticket barcode will be checked at the time of the exchange of the ticket by the wristband.

Each Festival venue has a legal limited capacity, so that once this limit is reached, access to such venue will be denied. Therefore, the Promoter will not be responsible for the impossibility of some Attendants to attend certain acts or performances that are part of the Festival.

On the entrance to the Festival’s venues, Attendants may be subject to registrations in accordance to current Law. It will not be allowed the entry of illegal objects or those considered dangerous by the Promoter, as well as professional cameras, video cameras or recorders. Nor will be allowed the entry of food and drink into the Festival’s venues.

INTELECTUAL AND INDUSTRIAL PROPERTY

The Attendants acknowledge and accept that the Promoter holds and is the owner of all intellectual and industrial property rights, including those of image, derived, directly or indirectly, from artistic performances or any other acts that take place on the Festival, without territorial or time limitation, and without any other limitation other than those provided in the current Intellectual Property Law. Consequently, taking or recording pictures, video or sounds for commercial purposes of any kind is strictly prohibited. The Promoter could eject any person who fails to comply with this obligation without being entitled to any refunds.

Attendants may appear in pictures that can be used and published on any platform. Attendants authorize for free to capture their image and voice in order to allow exploitation of the recordings that could be made during the Festival. Attendants also give consent to the dissemination of such content by the Promoter or third parties by any means, expressly consenting to a promotional and / or commercial use. In the same way, Attendants assign to the Promoter for free the heritage of their right of personal portrayal, for its exploitation by any type of communication, advertising, promotion, publication (including internet) or by any other means.

Under no circumstances will the Promoter satisfy any claims regarding an economic compensation for the exploitation of such images.

PROTECTION OF DATA

The Promoter and ENTRETENIMIENTO MUSICAL, S.L. (both entities belong to elrow Family Group) will be responsible for your personal data.

These entities may process your data to manage tickets sales, as well as to inform you about services, products and promotions of elrow Family Group, under any of their commercial names, brands and distinctive signs, unless you tell us otherwise.

CUSTOMER SERVICE AND CLAIMS

On the Festival there will be a customer service point, on which Attendants can manage all the incidents and claims they deem appropriate.

Any claim must be accompanied by a ticket or any other document that attests that the claimant is an Attendant of the Festival.

APLICABLE LAW AND JURISDICTION

These General Conditions are written in accordance with Act 34/2002, on services of the information society and electronic commerce (Ley 34/2002, de servicios de la sociedad de la información y de comercio electrónico), with Act 7/1998, on General Contract Conditions (Ley 7/1998, sobre Condiciones Generales de Contratación), with Royal Legislative Decree 1/2007, on General Law for the Defense of Consumers and Users (Real Decreto Legislativo 1/2007, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios), and other applicable legal provisions.

For the solution of any type of conflict parties agree to submit to the exclusive jurisdiction of the courts of Barcelona.
